Great Socialist People's Libyan Arab Jamahiriya (Libya) is the first country to ratify the Protocol on the Statute of the African Court of Justice and Human Rights. Libya’s instrument of ratification was deposited on June 16, 2009. The Protocol requires 14 more ratifications before it can come into force.
According to Article 9 of the Protocol, the Protocol and the Statute annexed to it shall enter into force thirty (30) days after the deposit of the instruments of ratification by fifteen (15) Member States of the African Union (AU).
To date the following countries have only signed the protocol:
1. Algeria
2. Benin
3. Burkina Faso
4. Chad
5. Congo
6. Cote d’Ivoire
7. Gabon
8. Gambia
9. Ghana,
10. Guinea
11. Malawi
12. Mali
13. Niger
14. Nigeria
15. Senegal
16. Sierra Leone
17. Tanzania
18. Togo
Thirty-Four AU member states are yet to sign this Protocol. The Protocol was adopted by the 11th Ordinary Session of the Assembly of the African Union, held in Sharm El-Sheikh, Egypt, 1st July 2008.
